Bankruptcy Decision Checklist – From an NJ Chapter 7, 13 & Credit Card Debt Lawyer
Here is a checklist for you to review if you are considering bankruptcy as a solution to your debt problems.
Learn about bankruptcy:
My name is attorney Joel R. Spivack, and I have more than 30 years of experience and knowledge that I will be happy to share with you. One of the first things that is important to understand is that there are two types of personal bankruptcy, Chapter 7 bankruptcy and Chapter 13 bankruptcy, each of which makes sense for different people in different situations.
Consider alternatives to bankruptcy: I am not interested in pushing you to file bankruptcy if there are other options available. My experience means I am familiar with other methods of overcoming debt, and I will help you determine whether those options could work for you.
Determine eligibility: If you are considering bankruptcy, you probably qualify for bankruptcy. However, I will start the process by verifying your eligibility.
Learn what bankruptcy can and cannot do: While the vast majority of credit card debts and other debts can be resolved through bankruptcy, some cannot. I will tell you if any of your debts cannot be resolved through bankruptcy and offer suggestions about dealing with those debts.
Find out what will happen to your home: Do you want to keep your house? It is important to learn exactly how bankruptcy will allow you to do so.
Find out what will happen to your car and other property: What do you want to keep? Depending on the type of bankruptcy you file, you may have to give up some property. I will work with you to design a plan based on your needs.
Find out how bankruptcy will impact your spouse: If you share debts with your spouse, it will impact the type of bankruptcy you file. I will take great care to protect your spouse and other loved ones you share debts with.
