Cherry Hill Chapter 7 Lawyer Explains the Ins and Outs of the Chapter 7 Bankruptcy Process

The idea of filing Chapter 7 bankruptcy can be intimidating if you do not know what you are getting into. My name is Joel R. Spivack, and I believe in taking the time to educate you about the process so you know exactly what you are getting into. I will also stand by your side through every stage of the process.

After you and I have worked together to determine that Chapter 7 bankruptcy is truly the right option for you, you can provide me with all the information needed to complete your bankruptcy forms. I ask that you provide as much of this information as possible upfront. I offer a checklist to make the information-gathering process easy for you.

The next step is credit counseling and a means test. The credit counseling requirement is fairly straightforward, and the means test is necessary to verify that you qualify for Chapter 7. Once these requirements are fulfilled, I will file the Chapter 7 forms on your behalf.

Joel R. Spivack Esq. Will Represent You at the Creditors Meeting

Approximately 30 days after filing, there will be a creditors meeting. You will be put under oath and you will be asked questions by the trustee who has been assigned to your case and by any creditors who have decided to attend. I will prepare you thoroughly for this meeting. I will also attend the meeting with you, although I am not allowed to speak for you.

If any challenges arise following the creditors meeting, I will address them. If not, you will receive a discharge that releases you from your debt. You will be able to proceed into a future free of creditor harassment and threats of home foreclosure and repossession.
