Who Is Eligible to File Bankruptcy?
In New Jersey, you are eligible to file Chapter 7 bankruptcy if your earnings are either below the median income in New Jersey or you meet the bankruptcy means test. In addition, you must not have filed bankruptcy in the past eight years.
During your free initial consultation, we will determine whether your income is above or below the median income. From there, we will determine what assets you own, your income and your living expenses to see if you qualify under the means test. This will enable us to determine whether you are eligible for Chapter 7 bankruptcy.
Even if you make too much money to file Chapter 7 bankruptcy, or have filed bankruptcy in the past eight years, you can still file Chapter 13 bankruptcy. The key question is which form of bankruptcy is the best way for you to get rid of debts. The goal of filing bankruptcy is to protect the assets you want to keep, eliminate as much debt as possible, and stop adverse actions such as foreclosure, repossession and garnishment.
