The Strengths of Chapter 13 Bankruptcy
Chapter 13 bankruptcy gives you the opportunity to address a broader range of debt. Some debts not addressed in Chapter 7, such as IRS debt or student loans, can be made part of the Chapter 13 repayment plan. This chapter of bankruptcy also opens doors that are not available in Chapter 7. For example, stripping second mortgages is an option under Chapter 13.
Under Chapter 13, you are not required to give up any of your property. Instead, you will be able to pay off mortgages and car loans that you have fallen behind on and reinstate the agreements. Foreclosure and repossession actions will be stopped in the process. If you have valuable property that is paid off, such as a car, you will not have to turn it over.
